Abstract

The issue of ability is one of the important issues in fundamental research, due to its jurisprudential effects on the obligated person. This fundamental issue is expressed as (the rule of the impossibility of obligation with what is not possible), and its purpose is to explain the jurisprudential and fundamental effects resulting from it, such as the conflict between the extended and restricted obligation. The nature of the research required defining ability, obligation, the evidence for the requirement of ability and its divisions, the difference between legal and rational ability, the cases in which obligation is required with ability, its requirement in the principles of the ruling, and the impossibility of obligation with what is not possible
